
Nationwide, Westfield works to help address one of the most pressing issues facing the property casualty insurance industry—rampant legal system abuse that drives up costs for consumers and businesses and threatens the integrity of our courts.
Below are a few of the legal system abuse reform (LSAR) campaigns that we’ve won this year, thanks in large part to the involvement and advocacy of dedicated employees, agents and others throughout the property casualty industry and business community.
Georgia Legal System Reform
In April 2025, the Georgia General Assembly passed—and Governor Brian Kemp signed into law—Senate Bills 68 and 69, hallmark legislation that encompassed the Governor’s LSAR priorities. SB 68 addresses premises liability, phantom damages, admissibility of seatbelt evidence, jury anchoring, and venue shopping. It also closes a loophole permitting duplicative recovery of attorney’s fees.
Meanwhile, SB 69 addresses third-party litigation funding, making several sweeping reforms that increase transparency into the practice and oversight of litigation financiers.
Maryland Non-Economic Damagers
When Maryland lawmakers were considering misguided legislation—House Bill 113—that would have eliminated the cap on non-economic damages, we helped employees and other stakeholders throughout the state speak out against this unwise policy move. If passed, HB 113 would have led to an increase in court costs that get passed down to consumers and more frequent and excessive “nuclear verdicts” that threaten local businesses and non-profit groups alike. Thanks in part to our advocacy efforts, this misguided legislation failed to advance.
