Supporting Balanced Utility Liability Policies 

Utility-ignited wildfires have become increasingly frequent and costly. Factors such as drought cycles, vegetation growth, and expanding development into wildland-urban interfaces have contributed to the growing risk. Utilities are now required in many states to implement wildfire mitigation plans, harden infrastructure, and manage vegetation to reduce ignition risks.  

Recent legislative efforts in several states have established liability shields for utilities that comply with approved mitigation plans. These laws often create presumptions of reasonable care, limit recoverable damages, and restrict strict liability standards. While these policies incentivize prevention, APCIA cautions that they may not fully protect consumers, as compliance with mitigation plans does not always guarantee safety or sufficient compensation for losses. 

APCIA supports strong prevention and mitigation standards, improved land and forest management, and the right to subrogate and recover economic losses from responsible parties. As wildfires continue to threaten lives and property, it is essential to maintain a fair balance between encouraging utility safety investments and ensuring that affected individuals and businesses can recover and rebuild.
